SARATOGA COUNTY, N.Y. -- A former Albany police officer has been sentenced to one year in jail after being convicted of criminal mischief.

Robert Schunk was convicted on criminal mischief and harassment stemming from a 2010 incident involving his ex-girlfriend. He was accused of going to his girlfriend's home in Halfmoon, breaking down a bathroom door and punching and kicking her.

In addition to the one year on the criminal mischief charge, Schunk was sentenced to 15 days for the harassment charge. His defense attorney says there are reversible errors in the case and she plans to fight the conviction.

"This conviction has about as good a chance of surviving as a snowball's chance in hell and I had no doubt based on how everything had happened,” said defense attorney Cheryl Coleman.

Schunk was kicked off the Albany police force in April following an arbitrator's ruling. He was suspended for two years before that, following a series of legal problems while he was a member of the department.
