WALLKILL, N.Y. – There is more trouble for the Wallkill Police Department. A third lawsuit has been filed in Orange County Superior Court against the Town of Wallkill and the police department.

The lawsuit states back in March 2011, several members of the Wallkill police force took an exam that would make them eligible candidates to be considered for police chief. The test has a life of four years. Under state civil service law, the town board has to choose a new police chief from this list of eligible candidates. But now the Town of Wallkill Town Board recently ordered a new test for police chief, refusing to make a choice from the current list of eligible candidates.

"So why are they now asking for another test? Well the reason is they don't like those candidates. That's not a permissible reason to circumvent civil service law. So we're basically asking a judge to stop that and to make them if they want a new chief to pick someone on the list," said Michael Sussman, Wallkill Police Benevolence Association Attorney.
